Pokies sit at the centre of Australian gambling culture, and the legal framework surrounding them is just as layered. The Interactive Gambling Act 2001 (IGA) is the key piece of Commonwealth legislation that governs online gambling services, yet it does not treat every type of wagering the same way. Understanding where electronic gaming machines, or pokies, fit within this structure helps players, venue operators and policymakers make sense of a rapidly shifting landscape. In simple terms, the IGA targets online gambling services provided to Australians. It prohibits certain interactive wagering activities while leaving other forms, such as sports betting, subject to strict licensing conditions. Pokies played on physical machines in pubs, clubs and casinos fall largely under state and territory law, which is why the national picture can look inconsistent from one jurisdiction to the next.

What the Interactive Gambling Act Actually Covers

The IGA came into force in 2001 and has been amended several times since, most notably in 2017 when parliament tightened rules around prohibited online services. It bans online casino-style games, including online pokies offered by offshore operators, from being provided to customers located in Australia. Penalties for breaches can reach into the millions of dollars for corporate offenders.

It is important to distinguish between prohibited and regulated services. Online sports betting and online lottery products are permitted where the operator holds a valid Australian licence. Online poker and online casino games, by contrast, sit in the prohibited category. This distinction explains why many players encounter offshore sites that operate in a legal grey zone.

Enforcement has become more sophisticated over time. The Australian Communications and Media Authority (ACMA) has powers to investigate complaints, issue formal warnings, and request that internet service providers block access to illegal gambling sites. Since these powers were expanded, hundreds of offshore domains have been blocked, signalling a firmer regulatory stance.

The Act also addresses advertising and inducements. Offering credit or bonuses to Australian customers for prohibited services is restricted, which affects how offshore operators market themselves. For players, this means the promotional claims found on some unregulated platforms carry real legal risk for the operators behind them.

How Pokies Are Regulated Across States and Territories

Land-based pokies are governed by state and territory legislation rather than the IGA. New South Wales operates the largest machine fleet in the country, with tens of thousands of approved gaming machines spread across hotels and clubs. Victoria, Queensland and South Australia each maintain their own caps, tax rates and harm-minimisation requirements.

Return-to-player rates vary by jurisdiction, generally sitting between 85% and 92% depending on the machine configuration and local rules. That means for every $100 cycled through a machine, players collectively receive back somewhere in that range over time. It is a statistical average, not a prediction for any individual session.

Harm-minimisation measures differ widely too. Some states mandate pre-commitment technology, while others rely on voluntary schemes, self-exclusion registers and staff intervention training. Tasmania and the ACT have introduced card-based play systems intended to track spending and encourage breaks in play.

Taxation is another point of divergence. Pokies revenue is a significant funding source for state budgets, contributing billions of dollars annually across the country. This revenue dependence shapes political debate and slows reform in some jurisdictions.

What the Rules Mean for Players

For everyday players, the practical takeaway is that online pokies from offshore providers are not legal to offer to Australians, even if the sites remain accessible. The IGA does not criminalise the act of playing, but it does place the legal burden on the operator, and players using unregulated sites have limited recourse if a dispute arises.

Regulated venues, whether physical or licensed online sportsbooks, offer clearer consumer protections. Dispute resolution schemes, responsible gambling tools and verified payout processes give players more confidence. Checking whether an operator holds an Australian licence is a quick way to separate legitimate services from risky ones.

• Online casino-style games, including pokies, are prohibited under the IGA.
• Land-based pokies are regulated by individual states and territories.
• ACMA can block illegal offshore gambling domains.
• Return-to-player rates typically range from 85% to 92%.
• Licensed operators must meet strict consumer protection standards.

The regulatory environment continues to evolve, with reviews of the IGA and state-level reforms appearing regularly. Staying informed about which services are legal and which are not remains the most reliable way for players to protect themselves.
